For one, you may not own the mineral rights to your own property. Some people don't realize that, but if you dig down, and you don't own the mineral rights, you are stealing someone else's clay by legal definition.

Digging down is harder and has more hazards, like mold. May need to run a pump constantly to remove water, and another for air.
It is easier to avoid detection since they use satellite to search for illegal structures.
