They don't. Even with the current rulings being biased (you can argue that), Congress can simply pass a new law that covers the conditions that the SCOTUS sets forth AND propose amendments to the US Constitution that enshrine the provisions.

The problem we have today is that part of the 3 leg stool is missing - Congress is effectively beholden to the executive branch out of political fear. So the SCOTUS can deliver rulings and there is no check on that power. This isn't an issue with the check and balance part of process, it's with the participants.
