Minnesota DHS doesn't have the legal responsibility or resources to "restore competency" so what they do is provisionally discharge the patients once they are "stabilized" to free up beds, and the judges can't simply have them locked up until they are competent again because there's a provision in the state constitution that prevents this. There was supposed to be a reform law to address it but it didn't even kick in until FY 2024 so who knows.
